Town Planning Scheme No. 3 Amendment Number 1

It is hereby notified for public information, in accordance with section 87 of the Planning and Development Act 2005 that the Minister for Planning approved the abovementioned amendment to the Shire of Serpentine Jarrahdale Town Planning Scheme No. 3 on 23 June 2026 for the purpose of:

1.           All applications for development approval relating to additional uses shall be at the local government's discretion and shall only be considered for approval if such development demonstrates there will be no unreasonable offsite impacts pertaining to odor, air emissions and/or dust.

 

2.     All applications for development approval must include suitable technical studies developed by qualified experts, to demonstrate how provision (1) will be achieved. Such studies are to be subject to independent peer review by a suitably qualified consultant, in order to assess the robustness of such studies and their recommendations.

 

3.     A condition of approval for the additional use shall require that the existing poultry farm approval is cancelled, pursuant to clause 77(d) of the Planning and Development (Local Planning Schemes) Regulations 2015, prior to commencement of the approved additional use.

 

4.     The local authority shall not grant planning approval for the additional use unless;

 

a)  A risk assessment has been prepared by a qualified expert to assess any potential risk that the proposed land use and development poses to the environment and in particular to the groundwater; and

 

b)  The application along with the supporting risk assessment have been referred to the Department of Water and Environmental Regulation for assessment and is supported prior to determination of the application.

 

5.     The Local Government shall not determine an application for development approval until it has received advice from the Department of Water and Environmental Regulation. Any development should not pose a greater risk to water quality then the current Poultry Farm use.

 

6.     Any application for development approval for the additional use must demonstrate a clear and measurable improvement to air-quality, odour emission reduction and rural amenity, through direct comparison to the existing Poultry Farm use.

 

7.     The additional use is restricted to the area of the existing previously approved sheds 1-5 (total area of 7,370m2), in addition to accessways/hardstand and incidental office space as indicated on an approved site plan.

 b. Amend the Scheme Map to delineate Lot 12 (No. 101) King Road, Oakford as Additional Use 20.
